Appeals of Annual Performance Evaluations
Right of Appeal
Employees who disagree with an evaluation required by Section 3 of the “Performance Management for University Staff Employees” policy and cannot resolve the disagreement with their manager may appeal to the reviewer for another review of the evaluation. Such appeal must be made in writing to the reviewer within 10 work days of the performance meeting between employee and manager (commencing on the day of the meeting).
Upon receiving an employee’s written appeal, the reviewer shall discuss the employee’s appeal with the manager and the employee. Following the discussion, the reviewer shall provide the employee (with a copy to the manager) a written response to the appeal within 5 work days of receiving it. The reviewer’s written response shall indicate one of the following:
- reviewer agrees with the original evaluation
- manager will revise the evaluation
- manager will complete a new evaluation
- reviewer will revise the evaluation
- reviewer will complete a new evaluation
Appeals of Reviewer Action
Employees who have concerns with the reviewer’s action may appeal that action to the appropriate Dean, Vice President, or designee. Such appeal must be made in writing within 10 work days of receiving the reviewer’s action (commencing on the day the reviewer’s decision is received by the employee). The Dean, Vice President, or designee shall discuss the concerns with the employee and either the manager, reviewer, or both. Following such discussion, the Dean, Vice President, or designee, shall provide the employee a written response (with copies to the manager and/or the reviewer) within 10 work days of receiving it, indicating one of the following:
- agreement with the original evaluation
- agreement with the reviewer’s or manager’s new or revised evaluation
- the manager and/or reviewer will complete a new evaluation
The decision of the Dean, Vice President, or designee is final.
Grievances and Performance Evaluations
Eligible employees may pursue certain complaints regarding performance evaluations through the State Grievance procedure (See Va. Code §§ 2.2-3000 et seq.) or the University policy for Resolving Grievances for University Staff Employees to the extent permitted by those policies and procedures.
